Andhra Pradesh Govt introduces Self-Certification / Third Party Certification; allows self-certification instead of departmental inspections; a move towards EODB

The Ministry of Commerce and Industry in a gazette Notification dated 8th December 2020 has recommended the introduction of Self Certification/Third Party Certification instead of Departmental inspections under all the Labour Laws with a view to improve Ease of Doing Business in the State of Andhra Pradesh. Hence, the State Government has decided to adopt the scheme of Certification /Third Party Certification (“Scheme”):

Enrolment under the Scheme:
1. All the medium risk establishments shall be eligible for the scheme.
2. The application for inclusion under the Scheme shall be made ONLINE as per Annexure -I of this Scheme. The same shall be addressed to the authorized authority of the concerned region.
3. On successful submission of the application, the establishment will be deemed to be enrolled under the Scheme. The responsibility for submission of Third Party Certification/audit report lies on the establishment.
4. A copy of the Certification / Audit Report shall be displayed prominently on the notice board of the establishment for the information of the employees.
5. The Scheme shall cover compliance and certification audit GO applicable for all inspections under Labour Laws.
6. Certification / Audit report submitted by third party agencies will be treated as preliminary compliance. In case of non-compliance, the department will issue a notice stating to comply within 15 days.
7. The establishment shall take a coercive action and upload compliance report within 15 days. The jurisdictional authorized officer will scrutinize the compliance report to see if the compliance is made. Immediate follow up actions on irregularities will be ensured if the employer fails to comply even after the opportunity for rectification is provided.
8. The department may inspect any establishment whenever any compliance issues are observed.
9. The establishment can opt to continue under the scheme by renewing the enrolment ONLINE before the expiry of enrolment period. The period of enrolment will start from the next day after the 3 years period from the previous enrolment and the certification / audit report will be required to be submitted within 90 days of the renewal of enrolment.
