Delhi Government notifies the Delhi Motor Vehicles (Amendment) Rules, 2019 ; mandates every person to provide their registered mobile number during pollution check

On 17th October 2019, the Transport Department of Delhi (“Department”) has notified the Draft Amendment to the Delhi Motor Vehicles Rules, 1993. The Draft Rules was earlier published  by the Department for inviting comments and suggestions.

As no objections were received by the Department from the public, the Amendment has now been notified.

The Notified Rules are called the Delhi Motor Vehicles (Amendment) Rules, 2019 and have come into force on the date of its publication in the Official Gazette i.e. on 17th October 2019.

Key Highlights:

 

  1. The notification has inserted new clause- sub rule (b) after clause (a) to sub rule 1Rule 99. The previous sub clause (b) will now be renumbered as sub clause (c).

  1. Rule 99 deals with air pollution caused by motor vehicles. Sub clause (a) mandates that every motor vehicle should carry a valid “Pollution Under Control Certificate” issued by the Transport Department or by a pollution checking centre, duly authorized by the Commissioner.

  1. The newly inserted sub clause (b) directs that any person availing the pollution checking facility should provide the mobile (cell phone) number of the registered owner of the motor vehicle during the pollution check. Further, the pollution checking centre should record the same in its database.
