The Food Safety and Standards Authority of India (“FSSAI”) has, by a Letter dated 6th June, 2018, extended the timeline for complying with the labelling requirements of frozen desserts or confections with added vegetable oil / fat and / or vegetable protein (“Frozen Desserts and Confections”), under clause 6(c) of sub-regulation 2.1.15 of the Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011 (“Regulations”), up to 1st January, 2019 or till further orders, whichever is earlier.
The FSSAI had, by a Notification [F. No. A-1(1)/Standards/MMP/2012] dated 12th October, 2017 (Please refer to the attached document ‘Amendment Regulations_ Notification’), notified the Food Safety and Standards (Food Products Standards and Food Additives) Thirteenth Amendment Regulations, 2017 (“Amendment Regulations”).
The Amendment Regulations substituted the regulation 2.1 of the Regulations, specifying revised standards for milk and milk products and a timeline upto 1st July, 2018 was given to Food Business Operators (“FBOs”) to comply with such standards.
However, representations were received from stakeholders regarding the labelling requirements of Frozen Desserts and Confections under clause 6(c) of sub-regulation 2.1.15 of the Regulations and their nomenclature in relation to ice-creams.
Hence, while such representations are under review by the FSSAI, it was decided to further extend the timeline by six months.
The FSSAI has clarified that the FBOs shall be required to comply with all other standards/ labelling requirements for Frozen Desserts and Confections under the Regulations.
