FSSAI issues draft Food Safety and Standards (Prohibition and Restriction on Sales) Amendment Regulations, 2018

In a notification dated 10th April, 2018, the Food Safety and Standards Authority of India (“FSSAI”) has issued the draft Food Safety and Standards (Prohibition and Restriction on Sales) Amendment Regulations, 2018 (“Draft Amendment Regulation”) to further amend the Food Safety and Standards (Prohibition and Restriction on Sales) Regulations, 2011 (“Principal Regulation”).

 

The Draft Amendment Regulation proposes to amend Regulation 2.3.12 of the Principal Regulation as follows:

Restriction on sale of common salt- No person shall sell or offer or expose for sale or have in his premises for the purpose of sale, the common salt, for direct human consumption unless the same is iodized:

 

Provided that common salt may be sold or exposed for sale or stored for sale for iodization, iron fortification, animal use, preservation, manufacturing medicines, and industrial use, under proper label declarations, as specified in the Regulation 2.4.5 (21 & 42) of Food Safety and Standards (Packaging and Labelling) regulations, 2011.

 

Regulation 2.3.12

 

Restriction on sale of common salt- No person shall sell or offer or expose for sale or have in his premises for the purpose of sale, common salt, for direct human consumption or for use as an ingredient in a food product unless the same is iodized:

 

Provided that common salt may be sold or exposed for sale or stored for sale for iodization, iron fortification, animal use, manufacturing medicines and industrial use, under proper label declarations, as specified in the Regulation 2.4.4 (21 & 42) of Food Safety and Standards (Packaging and Labelling) regulations, 2011.

 

 

The Draft Amendment Regulation proposes

 

  1. to restrict sale of non-iodized common salt for being used as an ingredient in a food product.

 

  1. to correct the provision reference made under the Proviso to Regulation 2.3.12 from Regulation 2.4.5 to Regulation 2.4.4 of the Food Safety and Standards (Packaging and Labelling) regulations, 2011.

Under the Food Safety and Standards (Packaging and Labelling) regulations, 2011, Regulation 2.4.4 deals with labelling of irradiated foods and Regulation 2.4.5 deals with the specific labelling requirements of other products. Hence, the Draft Amendment Regulation proposes to make such correction, so that common salt, sold or exposed for sale or stored for sale for iodization, iron fortification, animal use, manufacturing medicines and industrial use, are labelled as per the labelling requirements of irradiated food.

 

 

Objections and suggestions are invited from stakeholders on this Draft Amendment Regulations by 13th May,2018.
