Gazette notifications out to give effect to ROC to have jurisdiction over the Union Territories of Jammu & Kashmir and the Union Territory of Ladakh

Pursuant to the President’s assent granted to Jammu and Kashmir Reorganisation Bill on 9th August 2019, the Jammu and Kashmir Reorganisation Act, 2019 has come into force on 31st October 2019. The Jammu and Kashmir Reorganisation Act, 2019 contains provisions to reconstitute the state of Jammu and Kashmir into two Union Territories, Jammu & Kashmir, and Ladakh.

Accordingly, the Ministry of Corporate Affairs (MCA) has issued three separate Gazette Notifications, all dated 30th October 2019 operationalising certain provisions of the Companies Act, 2013 (“Act”) in the Union Territories of Jammu & Kashmir and Ladakh and bringing the said Union Territories under the jurisdiction of Registrar of Companies.

  • In Notification No. S.O.3955(E), MCA has issued information that the Registrar of Companies will have jurisdiction in respect of Union territory of Jammu and Kashmir and Union territory of Ladakh, for the purpose of registration of companies and discharging the functions under the relevant provisions of the Act.

 

Ø  In Notification No  S.O. 3956(E) , MCA has amended Notification No S.O.831 (E), dated the 24th March, 2015 (which laid down the jurisdiction of Registrar of Companies over each State  or Union Territory) and stated that the Registrar cum Official Liquidator of Jammu will have jurisdiction over the Union Territory of Jammu and Kashmir and the Union Territory of Ladakh.

Ø    In Notification No  S.O. 3957(E)MCA has amended its Notification No: G. S. R. 832(E) dated 3rd November, 2015 (which states the Office, Location and Jurisdiction of the Regional Directors under the Act) and stated that the office of the Regional Director, North Region Directorate, Headquarter at New Delhi will now have jurisdiction over the Union Territories of Jammu Kashmir and Ladakh.
