Government of Bihar notifies the Bihar Epidemic Diseases, COVID-19 (Amendment) Regulation, 2020; effective since 3rd July, 2020

The Government of Bihar has notified the Bihar Epidemic Diseases, COVID-19 Regulation, 2020 (“Regulation”) in an Order dated 3rd July, 2020 to further amend the Bihar Epidemic Diseases, COVID-19 Regulation, 2020.

The amendment has been implemented with immediate effect, in order to simplify the penalty clause and make it compoundable.

A new Regulation 19 A has been introduced (to amend Regulation 19) –

Regulation 19A:

“The State Government hereby authorizes all District Magistrates and also such Officers duly authorized by the District Magistrates within their respective jurisdiction to compound the offences punishable under section 188  of the Indian Penal Code for violating any provision of the Bihar Epidemic Diseases, COVID-19 Regulation, 2020 as provided under Regulation 19 (Penalty) of the said Regulation, 2020, by violating the order or Regulation prohibiting the actions specified in column-2 of the schedule given below for the amount specified against each of them in column 3 of the said schedule. ”

Offence – Any person not wearing face mask or face cover (nose and mouth covered properly) in public or work place –  Amount in Rupees for which offence is to be compounded – ₹ 50/-
