Govt. of Karnataka issues draft amendments to the Karnataka Boilers Rules, 1982 ; proposed changes to procedure of transfer of boilers, revised fees for examination and annual inspection of pipes and steam lines

The Government of Karnataka (“Government”) through a Notification No. LD 89 KaBaNi 2018, dated 18th June 2019 has proposed Draft Amendments to the Karnataka Boilers Rules, 1982 (“Rules”) by introducing the Karnataka Boiler (Amendment) Rules, 2019.

The implication note of the Rules vis-à-vis the Draft Amendments are provided below:

Rule 23- Procedure on transfer of a boiler-

 

Whenever a boiler is transferred from another state to the State of Karnataka the owner shall under section 6(b) apply to the Chief Inspector for Registration of the transfer. The boiler cannot be used until registration has been affected. The Chief Inspector shall obtain from the state from which the boiler was transferred the registration book and memorandum of inspection book of the boiler. No fee shall be charged for recording transfers.

Rule 23- Procedure on transfer of a boiler-

 

(1) Whenever a boiler is transferred to state of Karnataka from another state, the owner shall, under clause (b) of section 6 of the Act, apply to the Director of Boilers for the registration of the transfer. The boiler shall not be used until registration has been affected. The Director of Boilers shall obtain from the state from which the boiler was transferred, the Memorandum of Registration book and Memorandum of Inspection book of the boiler. A fee of two thousand shall be charged for records transfers.

(2) For transfer of Boilers within the State, the buyer shall make an application to the Director of Boilers along with certified copy of the registered Sale deed, No Objection Letter from the previous owner, Indemnity Bond on Rupees one hundred valued Stamp Paper and copy of last issued Boiler Certificate along with fee of rupees two thousand.

1. The Draft Amendment proposes to bring in changes in the procedure of transfer of a boiler from one state to another:

 

i. The application for transfer will need to be made before the Director of Boilers, instead of the Chief Inspector.

 

ii. Currently, no fee is charged for recording of transfers. Post the amendment , a fee of Rupees 2,000/- will be charged for record transfer.

 

2. Furthermore, under the Rules, there is no process of transfer of boiler within the state. The amendment will soon cover the procedure for such transfers, where the following procedure will have to be complied with:

 

the buyer shall make an application to the Director of Boilers along with:

 

i. Certified copy of the registered Sale deed,

 

ii. No Objection Letter from the previous owner,

 

iii. Indemnity Bond on Rs. 100/- valued Stamp Paper and

 

iv. Copy of last issued Boiler Certificate along with fee of Rs. 2,000/-.

Rule 72- Fees for examination of pipes and plans-

 

(a) The fee for examination of plans of steam, feed and blow off pipes shall be regulated as prescribed under Regulation 395(b) of the said regulations. The fee for the examination of plans of any fittings like de-superheaters, steam receivers, feed heaters, separately fired superheater headers and distribution headers shall be Rupees 100/-

 

(b) The fee for the examination of steam, feed and blow off pipes under fabrication shall be at the rate as prescribed under Regulation 395-B of the Regulations.

Rule 72- Fees for examination of pipes and plans –

(1) The fee for examination and approval of isometric layout plans of steam pipes, feed pipes and blow off pipes shall be charged at the rate of Rupees three hundred for thirty meters of piping or part thereof subject to a minimum of rupees three thousand including fittings like Pressure Reducing Station, De-super Heaters, Steam Receivers, Feed Heaters, Separately fired super heater headers and Steam Distribution Headers.
(2) The fee for examination of steam, feed and blow off pipes under fabrication shall be at the rate as prescribed under Regulation 395 (b) of the Regulations.

(3) A fee at a flat rate of rupees one thousand shall be paid if, after first scrutiny any alterations are suggestions and drawings are submitted for re-scrutiny with the suggestions.

(4) The fee for examination and approval of “As Built layout” plans of steam pipes, feed pipes and blow off pipes shall be charged at a flat rate of Rupees two thousand.

The Draft Amendment proposes to revise the fee for examination of pipes and plans.

1. The fee will be charged for examination and approval of isometric layout plans of steam pipes, feed pipes and blow off pipes.

2. The amount of the fee will soon be increased from Rs. 100 to Rs. 300/- for 30 meters of piping, subject to a minimum of Rs. 3000/- including fittings like Pressure Reducing Station, De-super Heaters, Steam Receivers, Feed Heaters, Separately fired super heater headers and Steam Distribution Headers.

3. A flat rate of Rs. 1,000/- will be required to be paid if, after first scrutiny any alterations are suggestions and drawings are submitted for re-scrutiny with the suggestions.

4. Additionally, the fee for examination and approval of “As Built layout” plans of steam pipes, feed pipes and blow off pipes shall be charged at a flat rate of Rs. 2000/-.

Rule 73- The fees for annual Inspection of steam lines shall be charged as under-

 

(a) For pipes of nominal bore not exceeding 100 mm inclusive of all fittings Rupees 60 /- for thirty metres of piping of part thereof.

 

(b) For pipes and nominal bore exceeding 100 mm inclusive of all fittings, Rupees 200/- for thirty metres of piping of part thereof.

Rule 73- The fees for annual Inspection of steam lines shall be charged as under

(1) For pipes of nominal bore not exceeding 100 mm inclusive of all fittings [rupees three hundred], for thirty meters of piping or part thereof.

(2) For pipes of nominal bore exceeding 100 mm inclusive of all fittings rupees six hundred for thirty meters of piping or part thereof.

The Draft Amendment proposes to increase the fees for inspection of steam lines of nominal bore pipes less than 100 mm and more than 100 mm.

For pipes less than 100 mm the fees will be increased from Rs. 60/- to Rs. 300/- for thirty meters of piping or part thereof.

For pipes more than 100 mm including all fittings, the fees will be increased from Rs. 200/- to  Rs. 600/- for thirty meters of piping or part thereof.
