Haryana State Employment of Local Candidates Bill, 2020 passed by State Assembly; proposes to provide 75% reservation to local candidates for private sector jobs in the State which pay less than Rs 50,000/- per month

With a view to provide reservation to the local candidates of Haryana in private employment and to boost local employment, the Haryana Vidhan Sabha has passed the Haryana State Employment of Local Candidates Bill, 2020 (“Bill”).

The Bill aims to provide 75% reservation to local candidates applying for private sector jobs in the State which pay less than Rs 50,000/- per month.

The provisions will be applicable to all Companies, Societies, Trusts, Limited Liability Partnership firms, Partnership Firms and any person employing ten or more persons.

Key Compliance Obligations:

• Employers to register employees earning gross monthly salary upto Rs. 50,000/- on the designated portal* within 3 months of this Bill coming into force; employment to be provided by employers only after registration on portal;

• Employers* shall employ 75% of the local candidates with respect to posts where the gross monthly salary or wages are not more than Rs. 50,000/- or as notified by the Government;

Note: In case adequate number of local candidates of desired skill, qualification or proficiency are not available, employers may claim exemption from the above-mentioned requirement by making an application to the Designated Officer.

• Employers to furnish a quarterly report of the local candidates employed and appointed during the quarter, on the designated portal;

• Penalties:

1. General penalty – Fine of not less than Rs. 10,000/- which may extend upto Rs. 50,000/-; and Rs. 100/- for each day till the time the contravention continues;

2. Penalty for non-compliance with requirement for compulsory registration – fine of not less than Rs. 25,000/- which may be extend upto Rs. 1,00,000/-; and Rs. 500/- for each day till the time the contravention continues;

3. Penalty for failure with regard to recruitment of local candidates – fine of not less than Rs. 50,000/- which may be extend upto Rs. 2,00,000/-; and Rs. 1,000/- for each day till the time the contravention continues.
