The Labour, Employment and Training Department, Jharkhand has recently notified the Jharkhand Shops & Establishment (Amendment) Rules, 2017 (“Amendment Rules”) thereby amending the Jharkhand Shops & Establishment Rules, 2001 (“Principal Rules”).
The Amendment Rules have come into force from 3rd October, 2017.

- Amendment in Fees for registration under the Jharkhand Shops and Establishments Act, 1953 (“Act”):
Rule 3(2) of the Principal Rules prescribe the fees that is required to be submitted for the purpose of registration of a shop/ establishment under the Act. The Amendment Rules have revised the registration fees. The revised fees are as follows:

Renewal of registration certificate:
A new Rule 3A has been inserted vide the Amendment Rules which prescribes the procedure for renewal of certificate of registration. As per the Amendment Rules, employers of every establishment have to apply for renewal of certificate of registration through on-line portal not less than thirty days before the date on which the certificate of registration expires, and if the application is made in such manner, then the establishment will be deemed to be duly registered and the certificate will be issued on-line immediately.
- Validity of registration certificate:
As per the Amendment Rules, every certificate of registration granted under Rule 3 or renewed under Rule 3-A, will remain in force upto 10 years. The certificate so granted or renewed will remain vaild upto 31st December of the applied period. Prior to this, the Principal Rules prescribed that every Registration Certificate that was issued under Rule 3 will remain valid till the closure of the concerned shop/ establishment.
The Amendment Rules have now prescribed that the Registration Certificate needs to be renewed once in every ten years.
- On-line application for registration:
The Amendment Rules have inserted a new proviso to Rule 3(3) that prescribes the procedure for registration. The new proviso states that where on-line application for registration has been made, the establishment shall be deemed to be registered on the basis of information furnished by the employer only and the registration certificate will be issued on-line immediately.
