Odisha SPCB says occupiers who do not require Consent to Operate or Consent to Establish under the Water and Air Act are also exempt from obtaining Authorization under the Hazardous Rules

The Odisha State Pollution Control Board (“OSPCB”) has, in a Notice dated 7th September 2020, stated that in case the Consent to Establish or Consent to Operate is not required from the State Pollution Control Board, Odisha under the Water (Prevention & Control of Pollution) Act, 1974 and Air ( Prevention & Control of Pollution ) Act, 1981, an occupier will not be required to obtain an authorization under Rule 6 (1) of the  Hazardous and Other Wastes (Management & Transboundary Movement) Rules, 2016 ( as amended in 2019) as well, provided hazardous and other wastes generated by such industries are handed over to the authorized actual users, waste collectors or disposal facilities.

 

This Notice has been issued by the OSPCB in sync with the Hazardous and Other Wastes (Management & Transboundary Movement) Amendment Rules, 2019
