PESO imposes additional conditions upon licensees holding license to fill / store compressed gas in cylinders (Gas Cylinder Rules) and store compressed gas in pressure vessels (SMPV Rules)

With a view to control / administer the transaction of cylinders and to monitor manufacturing and supply of medical oxygen to the hospitals, the Petroleum and Explosives Safety Organisation (“PESO”) has added additional conditions to Form-E, Form-F under Gas Cylinder Rules, 2016 (“GCR”) and Form LS-1A under Static and Mobile Pressure Vessels (Unfired) Rules, 2016 (“SMPV(U) Rules”).

These additional conditions are imposed upon licensees holding license to fill / store compressed gas in cylinders (Gas Cylinder Rules) and store compressed gas in pressure vessels (SMPV Rules).

The additional conditions are mandatory and will come into force immediately.

 

The additional conditions have been mentioned below:

Form E – License to fill compressed gas in cylinders Gas Cylinder Rules, 2016 All the licensees having license for filling of cylinders of Liquid Oxygen, industrial oxygen, medical oxygen and other industrial gases (other than LPG) shall maintain day record of filing of cylinders and shall submit the report to the Chief Controller of Explosives on daily basis at end of each working day in the format prescribed from time to time.
Form F – License to store compressed gas in cylinders Gas Cylinder Rules, 2016 All the licensees having license for storage of cylinders of Liquid Oxygen, industrial oxygen, medical oxygen and other industrial gases (other than LPG) shall maintain day record of filing of cylinders and shall submit the report to the Chief Controller of Explosives on daily basis at end of each working day in the format prescribed from time to time.
Form LS-1A – To store compressed gas in pressure vessels Static and Mobile Pressure Vessels (Unfired) Rules, 2016 All the licensees having license for storage of compressed gas (Liquid Oxygen, Oxygen, medical Oxygen) shall maintain day to day record of storage and dispatch of compressed gas and shall submit the report to the Chief Controller of Explosives in the format prescribed on daily basis at end of each working day in the format prescribed from time to time.

Background

Section 6D of the Explosives Act, 1884 says that the Licensing authority is competent to impose conditions in addition to prescribed conditions i.e., “A licence granted under section 6B may contain in addition to prescribed conditions such other conditions as may be considered necessary by the licensing authority in any particular case”. Therefore additional conditions have been imposed for the abovementioned forms.

Note – Non submission of information in the prescribed format of additional condition will attract relevant penal provisions of Explosives Act, 1884 and Rules.
