Punjab Pollution Control Board regulates documentation for obtaining one time authorization by traders under Hazardous and Other Waste (Management and Transboundary Movement) Rule, 2016

The Punjab Pollution Control Board (“Board”), for the effective implementation of the Hazardous and Other Waste (Management and Transboundary Movement) Rules, 2016 (“Rules”), has in an Office Order dated 24th January, 2019,  decided to regulate the documentation for submission of applications for obtaining one time authorization by the traders on the behalf of actual users under the Rules.

The Board has informed that the following documents have to be submitted along with the applications for obtaining one time authorization by the traders on the behalf of actual users as needed under Part D of Schedule III of the Rules, which prescribes the list of ‘other wastes’ applicable for import and export without permission from the Ministry of Environment, Forest and Climate Change:

  1.  Form 7 as per the Hazardous and Other Waste (Management and Transboundary Movement) Rules, 2016- Annexure A**
  2. Copy of the VAT/GST number.
  3. Copy of Import/Export Code issued to the trader.
  4. Copy of PAN number.
  5. Description and quantity of other wastes to be imported as per the Rules.
  6. Details of storage of raw material/ waste imported.
  7. Site plan/Location plan of the godown.
  8. Land documents of storage godown such as Registration deed/Jamabandi/ Rent deed/Lease deed indicating the details of the property.
  9. List of authorised actual users on behalf of trader intends to import other waste.
  10. Copy of consent to operator under the Water (Prevention and Control of Pollution) Act, 1974; or under the Air (prevention and Control of Pollution) Act, 1981 on each actual user on behalf of trader intends to import other wastes showing the quantity of raw material consumption to compare with the quantity of Hazardous and Other Waste (Management and Transboundary Movement) Rules, 2016 needs to import.
  11. Undertaking from authorised actual users on behalf of trader intends to import other waste- Annexure B**
  12. Undertaking from trader- Annexure C**
