In this blog post, we have highlighted the compliance impact associated with the commencement of these provisions, to help businesses to reassess and update their compliance processes accordingly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>List of Commenced Provisions<\/strong><\/h2>\n\n\n\n<p>By way of the Notification, the following provisions of FSSA have come into effect &#8211;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr2-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Section 2(c)<\/a> \u00a0<a href=\"https:\/\/sso.agc.gov.sg\/SL-Supp\/S709-2025\/Published\/20251117?DocDate=20251117\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">which\u00a0 states that the purpose of the Act is <\/a><em>\u00a0\u201c<\/em>to ensure that food in Singapore is safe and suitable for human consumption and that non\u2011packaged drinking water in Singapore is not unwholesome<em>\u201d<\/em>.<\/li>\n\n\n\n<li>\u2018Food Business\u2019 under <a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr5-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Section 5<\/a>.<\/li>\n\n\n\n<li>\u2018Primary Produce\u2019 and \u2018Unsafe Primary Produce\u2019 under <a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr5-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Section 14<\/a>.<\/li>\n\n\n\n<li>\u2018Primary Production Activity\u2019 under <a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr15-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Section 15<\/a>.<\/li>\n\n\n\n<li>\u2018Animal Feed\u2019 under <a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr16-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Section 16<\/a>.<\/li>\n\n\n\n<li>\u2018<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P15-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Part 5<\/a>\u2019 \u2013 Defined Food and Pre-Market Approval.<\/li>\n\n\n\n<li>\u2018<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P16-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Part 6<\/a>\u2019 \u2013 Compliance Related to Non-Packaged Drinking Water.<\/li>\n\n\n\n<li>\u2018<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P112-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Part 12<\/a>\u2019 &#8211; Appeals (Section 224-229)<\/li>\n\n\n\n<li>\u2018<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P113-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Part 13<\/a>\u2019 \u2013 Monitoring and Enforcement (Sections 230-273)<\/li>\n\n\n\n<li>\u2018<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P114-\">Part<\/a><a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P114-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> <\/a><a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P114-\">14<\/a>\u2019 \u2013 Administration (Sections 274-306)<\/li>\n\n\n\n<li>\u2018<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P116-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Part 16<\/a>\u2019 \u2013 Miscellaneous (Sections 319-321).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key sections in the Notification<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1. Definitions in Section 3(1)<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>What it covers&nbsp;<\/strong><\/h4>\n\n\n\n<p>The Notification activates an extensive list of definitions, including terms such as Advertise, Advertisement, Agency, SFA officer, Food, Food additive, Defined food, Novel food, among others.&nbsp;While definitions themselves do not create duties, they determine the scope of regulatory obligations and support the legal framework for the operative provisions that have been commenced or will commence in future phases.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Compliance impact&nbsp;<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Businesses must now classify themselves correctly (e.g., whether they fall within the definition of \u201cfood business\u201d?) as many future obligations depend on these terms.<\/li>\n\n\n\n<li>Online sellers must understand and assess \u201cadvertising\u201d, \u201conline location\u201d, \u201ccontent\u201d.<\/li>\n\n\n\n<li>The\u00a0commencement of these definitions enables the Singapore Food Agency (SFA) to apply enforcement powers, once linked operative Parts of the FSSA effectuate, and ensure these Parts operate as intended from their effective date.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2. Section 3(2) to Section 3(8)&nbsp;<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>What it covers&nbsp;<\/strong><\/h4>\n\n\n\n<p>These provisions determine what counts as \u201ccontent\u201d, a \u201clabel\u201d, how information must be produced (in legible form and in English), the continuing nature of obligations after deadline lapses and territorial application.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Compliance impact <\/strong>&nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Maintain internal checks to prevent violations and respond promptly to issues relating to labelling, advertising or product description.<\/li>\n\n\n\n<li>Maintain processes to ensure that content and labels are not misleading or incomplete, given the expanded treatment of linked content.<\/li>\n\n\n\n<li>Businesses must ensure ongoing monitoring of linked digital content as hyperlink or QR-accessible content is treated as part of the \u201ccontent\u201d or \u201clabel\u201d.<\/li>\n\n\n\n<li>Maintain version control and records for digital content and labels for audit purpose.<\/li>\n\n\n\n<li>Have systems and processes in place to prevent misleading or deceptive labelling of food.<\/li>\n\n\n\n<li>Where information is not in English, ensure accurate translation and ensure content is legible.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">3. <strong>Section 4 (Meaning of Food)<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>What it covers<\/strong><\/h4>\n\n\n\n<p>The commencement notification brings <a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr4-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Section 4<\/a> into force. This section defines the meaning of \u201cfood\u201d, and the definition encompasses any substance or thing that is used, capable of being used, or represented as being for use in human consumption, whether live, raw, prepared, or partly prepared. The commencement of this definition does not itself create any compliance obligation on food businesses, but it provides greater clarity on the scope and coverage of the operative provisions for food businesses to determine whether their operations and products fall within the FSSA or not.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Compliance Impact &nbsp;<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Have systems and processes in place to assess whether your business operation falls under the purview of the definition of \u2018food\u2019 or not.<\/li>\n\n\n\n<li>Businesses producing products that qualify as defined foods (e.g., novel or genetically modified food) will need to comply with Part 5.<\/li>\n\n\n\n<li>Have systems and processes in place to prevent misleading or deceptive labelling of food. Businesses must implement internal compliance monitoring to ensure that products classified as \u201cfood\u201d are continuously reassessed as new Parts of the Act commence and additional obligations become applicable.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4. Section 5 (1) to Section 5 (3) (Food business)<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>What it covers &nbsp;<\/strong><\/h4>\n\n\n\n<p>Singapore has operationalised the definition of \u2018food business\u2019. Part 4 of the FSSA 2025 mandates licensing requirements for a food business to carry out a licensable food business, prelisted in the <a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#Sc1-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">First Schedule<\/a> to the FSSA. Businesses must be compliance ready when Part 4 of the FSSA will gain force in a future phase.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Compliance Impact&nbsp;<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Have systems and processes in place to determine whether your business operation falls under the purview of the definition of \u2018food business\u2019 or not.<\/li>\n\n\n\n<li>Businesses whose activities will be licensable in future should begin preparing relevant internal processes (e.g., management plans, hygiene controls) in anticipation of commencement of <a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P14-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Part 4<\/a>.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">5. <strong>Section 7 to Section 10 (Meaning of advertise, sell, supply, handling, etc.)<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>What it covers\u00a0<\/strong><\/h4>\n\n\n\n<p>Section 7 to 10 of the FSSA 2025 stipulates the meaning of the terms like \u2013 \u2018advertise\u2019, \u2018sell\u2019, \u2018supply\u2019, \u2018handling\u2019, \u2018manufacturing\u2019 and \u2018preparing\u2019. Businesses must evaluate and review their operations against the scope of these definitions to stay ahead of the compliance curve.<\/p>\n\n\n\n<p>Section 9 defines \u201chandling\u201d and therefore determines whether an act constitutes \u201chandling\u201d for the purposes of offences prescribed under <a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P18-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Part 8<\/a> of the FSSA 2025, including provisions such as sections 142, 152 and 153, which are commenced under the Notification.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Compliance Impact&nbsp;<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Maintain records showing reasonable precautions taken to prevent unauthorised supply, as\u00a0<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr108-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">due diligence is a defence<\/a>\u00a0available.<\/li>\n\n\n\n<li>Have processes in place to avoid supplying falsely described food.<\/li>\n\n\n\n<li>Maintain internal checks to prevent violations and respond promptly to issues relating to labelling, advertising or product description.<\/li>\n\n\n\n<li>Identify \u201cdefined food\u201d in your product range to ensure you do not advertise it unless permitted under the law.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">6. <strong>Section 13 (Defined Food)<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>What it covers\u00a0<\/strong><\/h4>\n\n\n\n<p>The notification brings Section 13 of the FSSA Act into force, which defines the term \u201cDefined Food.\u201d Under the FSSA 2025 businesses must obtain\u00a0<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P15-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">pre-market approval<\/a>\u00a0from the Singapore Food Agency before supplying novel or genetically modified foods (collectively referred to as \u201cdefined foods\u201d).<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Compliance impact&nbsp;<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ensure compliance with all conditions attached to the pre-market approval.<\/li>\n\n\n\n<li>Keep track of the validity of the pre-market approval.<\/li>\n\n\n\n<li>Do not\u00a0<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr113-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">transfer or assign<\/a>\u00a0the approval unless there is a provision to do so in the approval or with written consent of the SFA. This could be a relevant factor in the event of any business restructuring.<\/li>\n\n\n\n<li>Maintain records, showing reasonable precautions taken to prevent unauthorised supply, as\u00a0<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr108-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">due diligence is a defence<\/a>\u00a0available.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>7. Section 14<\/strong> <strong>(Primary Produce &amp; Unsafe Primary Food)<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>What it covers<\/strong><\/h4>\n\n\n\n<p>The commencement notification brings into force Section 14, which stipulates the terms \u2018primary produce\u2019 and \u2018unsafe primary produce\u2019. FSSA 2025 under <a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?ProvIds=P17-#P17-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><strong>Part 7<\/strong><\/a> outlines the requirement to strictly adhere to the directions of the Director-General for maintaining food safety and executing sustainable primary production measures. Hence though Part 7 has not commenced yet, businesses can prepare for compliance obligations that will arise in future.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Compliance Impact<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Businesses involved in early-stage food production must correctly identify whether their output constitutes \u201cprimary produce\u201d.<\/li>\n\n\n\n<li>The distinction between \u201cprimary produce\u201d and \u201cunsafe primary produce\u201d will become relevant once the operational Parts governing safety measures are commenced.<\/li>\n\n\n\n<li>Businesses should develop internal processes to assess safety risks in primary produce in preparation for future commencement of related Parts.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">8. <strong>Sections 15 &amp; 16 (Primary Production Activity and Animal Feed)<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>What it covers\u00a0<\/strong><\/h4>\n\n\n\n<p>Singapore has brought the definitions of \u2018<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr15-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Primary production activity<\/a>\u2019 and \u2018<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr16-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Animal feed<\/a>\u2019 into force through the commencement notification. Once the related parts commence in future phases, the Director\u2011General may issue binding directions to manage risks related to animal feed and primary production activities.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Compliance Impact<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Businesses must determine whether their activities fall under \u201cprimary production activity\u201d for the purposes of future licensing and operational requirements.<\/li>\n\n\n\n<li>Businesses supplying or using animal feed, should understand the statutory definition, as this will trigger obligations under future commenced Parts relating to feed safety.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/lexplosion.in\/singapore\/key-compliances-under-singapores-food-safety-and-security-act-2025-part-1\/\"><strong>P<\/strong><\/a><strong><a href=\"https:\/\/lexplosion.in\/singapore\/key-compliances-under-singapores-food-safety-and-security-act-2025-part-1\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a<\/a><\/strong><a href=\"https:\/\/lexplosion.in\/singapore\/key-compliances-under-singapores-food-safety-and-security-act-2025-part-1\/\"><strong>rt 5<\/strong><\/a><strong> (<\/strong><a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P15-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><strong>Pre-Market Approval for Defined Foods<\/strong><\/a><strong>)<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>What it covers<\/strong><strong><\/strong><\/h4>\n\n\n\n<p>Under the FSSA 2025 businesses must obtain\u00a0<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#P15-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">pre-market approval<\/a>\u00a0from the Singapore Food Agency before supplying novel or genetically modified foods (collectively referred to as \u201c<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr13-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">defined foods<\/a>\u201d). This approval is granted after a safety assessment considering factors such as potential health risks, composition, production methods, source and consumption levels. A defence of due diligence is available under limited circumstances. Supplying defined food without approval, whether knowingly or not is an offence, with strict liability applying and penalties including fines and imprisonment.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Key compliances<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Determine and submit a complete application for a pre-market approval to the Singapore Food Agency (SFA) if your product qualifies as a defined food under the FSSA 2025 (which includes novel food or genetically modified food).<\/li>\n\n\n\n<li>Ensure compliance with all conditions attached to the pre-market approval.<\/li>\n\n\n\n<li>Keep track of the validity of the pre-market approval.<\/li>\n\n\n\n<li>Do not\u00a0<a href=\"https:\/\/sso.agc.gov.sg\/Act\/FSSA2025?WholeDoc=1#pr113-\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">transfer or assign<\/a>\u00a0the approval unless there is a provision to do so in the approval or with written consent of the SFA.
