The Digital Personal Data Protection Act, 2023, which has been passed by both Houses of the Parliament recently received Presidential assent. However, it is yet to gain the force of law and timelines for implementation are yet to be finalized.

We at Lexplosion Solutions have closely followed the journey of this law and conducted a webinar on – ‘Preparing Businesses for the New Data Protection Regime: Key Compliance Indicators’.

Earlier in November 2022 the MeitY has published a revamped version of the proposed Data Protection law in India titled ‘Digital Personal Data Protection Bill, 2022’. The purpose of the draft Bill is to provide processing of digital personal data in a manner that recognizes both the right of individuals to protect their personal data and the need to process personal data for lawful purposes, and for matters connected or incidental to it. The Ministry has invited feedback on the bill till 17th December, 2022.

In India the Department of Consumer Affairs set up a committee to develop a comprehensive framework for ‘Right to Repair’. It requires original equipment manufacturers (OEM) to make diagnostic and repair information available to independent repair providers and consumers. In the essence of BRSR, it encourages E-waste handling through recycling, re-using, or other recovery operations. In the process it is trying to empower the consumers and achieve circular economy by empowering independent repair providers.

An amendment with respect to Business Responsibility Reporting in SEBI (Listing Obligations and Disclosure Requirements), 2015 introducing the Business Responsibility and Sustainability Reporting has impacted the top 1000 listed companies and their operations in various ways. This amendment is making the existing sustainability reporting to be more expansive and inclusive and adding more layers of record maintenance on the companies.

You may be aware that the Labour Codes are on the verge of being implemented. While some media sources speculate that these might be notified by the end of this quarter, some others say/believe that the date is sooner.

While the date of implementation remains unknown, the question remains “Are you ready for the Labour Codes and the impact thereof on your business processes?”
