The Government of Delhi has notified the Delhi Transgender Persons (Protection of Rights) Rules, 2025 (“Rules”). The Rules prescribes a framework for protecting the rights and welfare of transgender persons focusing on non-discrimination, access to services, and grievance redressal. This is effective immediately.
Key compliance obligations under the Rules:
- The Rules prohibit discrimination against transgender persons in various spheres, including education, employment, healthcare, access to public services, and the right to reside in and own property.
- Every establishment to implement measures for providing a safe working environment to ensure that transgender person is not discriminated in matters relating to employment, infrastructure adjustments, recruitment, employment benefits, promotion, and other related issues.
- Establishments to publish an equal opportunity policy for transgender persons. The policy must be displayed at a conspicuous place which will include the following details like:
- infrastructural facilities (such as unisex toilets), measures put in for safety and security (transportation and guards) and amenities (such as hygiene products);
- applicability of all rules and regulations of the company regarding service conditions of employees;
- confidentiality of the gender identity of the employees;
- complaint of the officers.
- Designate a complaints officer for grievance redressal, who will enquire into the complaints received within a specified time.
