Delhi Transgender Persons (Protection of Rights) Rules, 2025 notified; establishments to implement equal opportunity policy for transgender persons, prohibition on non-discrimination

The Government of Delhi has notified the Delhi Transgender Persons (Protection of Rights) Rules, 2025 (“Rules”). The Rules prescribes a framework for protecting the rights and welfare of transgender persons focusing on non-discrimination, access to services, and grievance redressal. This is effective immediately.

Key compliance obligations under the Rules:

  1. The Rules prohibit discrimination against transgender persons in various spheres, including education, employment, healthcare, access to public services, and the right to reside in and own property.
  2. Every establishment to implement measures for providing a safe working environment to ensure that transgender person is not discriminated in matters relating to employment, infrastructure adjustments, recruitment, employment benefits, promotion, and other related issues.
  3. Establishments to publish an equal opportunity policy for transgender persons. The policy must be displayed at a conspicuous place which will include the following details like:
    1. infrastructural facilities (such as unisex toilets), measures put in for safety and security (transportation and guards) and amenities (such as hygiene products);
    2. applicability of all rules and regulations of the company regarding service conditions of employees;
    3. confidentiality of the gender identity of the employees;
    4. complaint of the officers.
  4. Designate a complaints officer for grievance redressal, who will enquire into the complaints received within a specified time.
