Government issues draft of the Code on Social Security (Central) Rules, 2025; invites comments within 13.02.2026

The Government of Andhra Pradesh has issued the Draft Code on Social Security (Andhra Pradesh) Rules, 2026 (“Draft Rules”) under the Code on Social Security, 2020. The Draft Rules are proposed to replace the existing state rules relating to employees’ compensation, maternity benefit, gratuity and unorganised workers’ social security, in line with the implementation of the Code on Social Security, 2020 (“Code”).

Stakeholders may submit objections or suggestions with respect to the Draft Rules to the Commissioner of Labour, Andhra Pradesh, Vijayawada through the dedicated web

portal of the Labour Department Web Portal “https://labour.ap.gov.in/”, by email to aplabourcodes2026@gmail.com or may submitted in the Office of the Commissioner of Labour, Andhra Pradesh, Papaiah Street, Seetharampuram, VIJAYAWADA – 520010 within the 45 days period from the date on which copies of the Official Gazette are made available to the public, i.e., 9th April 2026.

Key Highlights:

  1. The Draft Rules propose to provide for the constitution, composition, nomination of members, tenure, meetings, quorum, resignation and reconstitution of the Andhra Pradesh Unorganised Workers’ Social Security Board.
  2. The Draft Rules seek to regulate the constitution, administration and functioning of the Andhra Pradesh Building and Other Construction Workers’ Welfare Board, including welfare schemes and benefits for building workers.
  3. The Draft Rules propose to establish an Employees’ State Insurance Society in the State, comprising a governing body, executive committee and secretariat to manage and administer healthcare and insurance services under the Employees’ State Insurance framework.
  4. The Draft Rules set out provisions governing the procedure and jurisdiction of the Employees’ Insurance Court, including the filing and transfer of proceedings and adjudication of disputes relating to insured persons and employers.
  5. The Draft Rules prescribe procedures relating to gratuity, including nomination, modification of nomination, handling of gratuity payable to minors, and recovery of gratuity dues through the competent authority.
  6. The Draft Rules lay down a framework relating to maternity benefit, including the submission of medical certificates, notice of claim, payment of benefits by employers, complaints to the Inspector-cum-Facilitator, and appeals before the prescribed authority.
  7. The Draft Rules further prescribe provisions relating to social security and cess in respect of building and other construction workers, including the time limits for payment of cess and fees for appeals.
