Delhi Fire Service Rules, 2010 amended; Fire Safety Certificate to remain valid unless suspended or cancelled

The Home Department, Delhi (“Delhi”) notifies the Delhi Fire Service (Amendment) Rules, 2025 (“Amendment Rules”) to further amend the Delhi Fire Service Rules, 2010 (“Principal Rules”). This is effective immediately. However, for the amendments to the following provisions mentioned below will gain effect from 24th August 2026:
- Rule 34- Issue of fire prevention and fire safety measures;
- Rule 35- Fire Safety Certificate to be issued;
- Rule 36- Duration of Fire Safety Certificate;
- Rule 37- Renewal of Fire Safety Certificate;
- Rule 38- Liability to maintain fire safety measures;
- First Schedule; and
- Seventh Schedule.
Key Highlights:
1. The Amendment Rules introduces the definition of Fire safety Officer which means a Third Party i.e., a person or an association of persons or company as referred to in rules and the Seventh Schedule of these Rules, duly empanelled with the Director of Delhi Fire Service.
2. The classes of occupancies construed to likely cause a risk of fire has been revised as follows:
- Pandal having seating capacity more than 50 persons or covered area more than 50 square meters.
- Residential buildings (other than hotels and guest houses) having height more than 15 meters or comprised of Five or more stories, including mezzanine/stilt floor above ground level.
- Hotels and guest houses building having height more than 12 meters or comprised of 4 or more stories, including mezzanine/stilt floor above ground level.
- Educational buildings having height more than 9 meters or comprised of 3 or more stories, including mezzanine/stilt floor above ground level.
- Institutional buildings having height more than 9 meters or comprised of 3 or more stories, including mezzanine/stilt floor above ground level.
- All Assembly buildings.
- Business buildings having height more than 15 meters or comprised of 5 or more stories, including mezzanine/stilt floor above ground level.
- Mercantile buildings having height more than 9 meters or comprised of 3 or more stories, including mezzanine/stilt floor above ground level.
- Industrial buildings having covered area on all stories more than 250 square meters.
- Storage buildings having covered area on all stories more than 250 square meters.
- All Hazardous buildings having covered area on all stories more than 100 square meters.
- Underground Structures comprising of 2 or more Levels.
3. The Director or nominated authority will now issue notice in Form N instead of Form M to the owner or occupier to appoint a fire safety officer.
4. The Fire Safety Auditor, owner, occupier of a premise or building or occupancy are now required to engage Fire Safety Auditor from the list of Fire Safety Auditors on the portal of Delhi Fire Service.
5. The Fire Safety Auditor or the owner or the occupier are required to make online submission of the following to the Director:
- Fire Safety Certificate in Form ‘H’;
- Declaration in Form ‘I’;
- Inspection report in Form ‘J’;
- Fee of Rupees One Thousand through bank draft/pay order to the DDO (Headquarters), Delhi Fire Service payable at Delhi or through an online payment gateway.
6. The Fire Safety Certificate is now valid unless suspended or cancelled by Delhi Fire Service subject to the submission of Form K every year. The Fire Safety Auditor or the Fire Safety Officer or the owner or the occupier must submit online declaration in Form K prior to the completion of one year from the issuance date of Fire Safety Certificate.
7. The requirement of renewal of Fire Safety Certificate has been done away with.
8. The Amendment Rule introduces that the owner or occupier of the premise or building must provide an Automated Continuous Monitoring System for fire prevention and fire safety measures.
9. The owner or occupier or Fire Safety Auditor or Fire Safety Officer appointed the following must be submitted online to the Director every year:
- Declaration in Form ‘K’.
- Fee of Rs. 1000 through bank draft/pay order to the DDO (Headquarters), Delhi Fire Service payable at Delhi or through an online payment gateway.
10. The Amendment Rules further amends various forms under the Principal Rules.
