Delhi Jan Vishwas (Amendment of Provisions) Bill, 2026 introduced in Legislative Assembly of the NCT Delhi; aims to promote ease of doing business by decriminalizing and rationalising offences

The Government of National Capital Territory (“NCT”) of Delhi has introduced the Delhi Jan Vishwas (Amendment of Provisions) Bill, 2026 (“Bill”) in the Legislative Assembly of NCT Delhi, with a view to amend certain enactments for decriminalising and rationalising minor offences to further enhance trust-based governance and ensure time bound delivery of notified public service for ease of living and doing business.

Some of the changes proposed to the penalty provisions of certain legislations are as follows:

Delhi Shops and Establishments Act, 1954Under Section 40(1), the penalty for contravening any of the provisions of the Act or Rules (except sections 33, **41 and ***42), the fine has been modified to Rs. 10,000/- to Rs. 25,000/- Under Section 40(2), the fine for continuous violation of the provision pertaining to maintenance of records has been increased from Rs. 5 to Rs. 250/- to 500/- per day. Under Section 41, the earlier penalty for making false entries in any record, register, or notice was imprisonment upto 3 months, or a fine of Rs. 50/- to Rs. 250/-, or both. This penalty provision has been modified, removing imprisonment as a penalty and increasing the existing fine to Rs. 500/- to Rs. 5000/-. Under Section 42, the penalty for willfully obstructing obstructing, resisting, or any other activity will now be proceeded in accordance with the provisions of Bharatiya Nyaya Sanhita, 2023.
Delhi Agricultural Produce Marketing (Regulation) Act, 1998Under Section 103, the earlier prescribed penalty was imprisonment upto 1 month, or fine of Rs. 5000/-, or both. The Bill has proposed to modify this penalty provision by removing imprisonment as a penalty and increasing the existing fine to Rs. 50,000/-   Under Section 104, the earlier prescribed penalty was imprisonment upto 6 months, or fine of Rs. 5000/-, or both. The earlier prescribed fine for continuous offence was Rs 100/- per day. The Bill has further proposed to modify this penalty provision by removing imprisonment as a penalty and increasing the existing fine to Rs. 25,000/-. The new prescribed fine for commission of continuous offence is Rs. 500/- per day.   Under Section 108, the earlier prescribed fine was Rs. 2000/-. The Bill has proposed to increase this fine to Rs. 10,000/-
