Rajasthan Government issues Draft Rajasthan Occupational Safety, Health and Working Conditions Rules, 2026; comments invited within 45 days from the date of its publication in the Official Gazette

The Rajasthan Government has issued the Draft Rajasthan Occupational Safety, Health and Working Conditions Rules, 2026 (“Draft Rules”) under the Occupational Safety, Health and Working Conditions Code, 2019 (“Code”). Objections and suggestions to the Draft Rules may be addressed to the Chief Inspector of Factories and Boilers, 6C, Jhalana Institutional Area, JLN Marg, Jaipur – 302004, in writing or by e-mail at cifb@rajasthan.gov.in, by 20th March 2026, i.e., within a period of 45 days from the date of its publication in the Official Gazette.

Key Proposals under the Draft Rules:

  1. Obtain registration by making an online application on portal for registration of establishments by giving details about the establishment and uploading documents related to registration of the establishment, proof of identity and address.
  2. Lay down duties of employer which includes annual health examination of employees, letter of appointment, notice of accidents and dangerous occurrences, notice of disease etc.
  3. Establish Safety Committee for establishments or factories employing 500 or more workers and prescribes the duties of Safety Officers of such Committee.
  4. Prescribe daily and weekly working hours, wages for overtime and compensatory holidays.
  5. Prescribe maintenance of register of workers and employees, register of attendance cum-muster roll, register of wages, overtime and deductions, register of leave with wages, electronically or otherwise.
  6. Prescribe display of notice showing the name and address of the factory or establishment, hours of work, wage period, date of payment of such wages, details of accident and dangerous occurrence in the establishment for the last five years, etc, at the conspicuous places of the factory or establishment.
  7. Prescribe annual submission of a return regarding category of employees, health & welfare facilities retrenchment/ layoffs, bonus, maternity benefits etc. to the Inspector-cum Facilitator by 1st February every year.
  8. Prescribe conditions relating to employment of women at factory/establishment during night or before 6.00 a.m. and beyond 7.00 p.m.
  9. Conditions for grant of license to a contractor, procedure for issue of license, along with renewal of license have been specified.
  10. Prescribe provision of journey allowance for Inter-State Migrant Workers.
