CPCB mandates registration on Common Extended Producer Portal by stakeholders under Plastic Waste Management Rules, 2016

The Central Pollution Control Board (“CPCB”) mandates registration on the Common Extended Producer Portal (“CEPR Portal”) by the following entities under the Plastic Waste Management Rules, 2016 (“Rules”):

a. Producers including micro and small enterprises as defined under the Micro, Small and Medium Enterprises Development Act, 2006;

b. Importers of plastic packaging & raw material;

c. Brand Owners;

d. Manufacturers of plastic raw materials & items made from compostable plastics or biodegradable plastics;

e. Seller; and

f. Plastic Waste Processors (“PWPs”) engaged in recycling, waste to energy, waste to oil and industrial composting.

Key Highlights:

1. The CEPR Portal enables registration, transaction reporting, EPR target compliance, and annual return filing.

2. The following non-compliances have been observed by CPCB:

1. Certain entities remain unregistered despite their statutory obligations.
2. Transaction (purchase/sale) are being conducted with unregistered entities, in contravention of the Rules.

3. CPCB is strengthening transaction-based reporting mechanism on the CEPR Portal.

4. The declaration / recording of transactions (purchase/sale) with unregistered entities will be discontinued on the CEPR Portal, except in respect of Brand Owners (micro & small) and PWPs related transactions, as applicable.

5. The stakeholders to ensure immediate registration on the CEPR Portal and conduct all business transactions relating to plastic packaging / plastic waste strictly in compliance with regulatory requirements while duly reporting them through the CEPR Portal.

6. The stakeholders must also ensure that their unregistered suppliers and buyers to obtain registration immediately to enable continued transaction reporting.

7. Non-compliance with these provisions will attract action in accordance with the Rules.
