Andhra Pradesh Govt. imposes specific penalty to ensure effective implementation of the ban on Single Use Plastic (“SUP”)” items

In addition to the penalty imposed by the Andhra Pradesh Pollution Control Board in its Public Notice imposing a ban on Single Use Plastic (“SUP”) items, (please refer to e-mail in trail for summary), the Government of Andhra Pradesh has additionally imposed the following specific penalties to ensure effective implementation of the ban on identified SUP items:

1. Levy of Penalties by APPCB Authorities/Municipal Authorities:

A. Manufacturing and Import of Banned SUP items:

i. Fine of Rs. 50,000 and seizure of the banned SUP items for First Offence;

ii. Fine of Rs. 1,00,000 and seizure of the banned SUP items along with cancellation of Consent/ Registration/ seizure of plant and machinery in addition to launching of Prosecution under Environment (Protection) Act, 1986 for Second Offence;

B. Stocking and Distribution of Banned SUP Items by Producers, Importers, E-Commerce Companies

i. Fine of Rs. 25,000 and Rs. 10/Kg of banned SUP items and seizure of material for First Offence

ii. Fine of Rs. 50,000 and Rs. 20/Kg of banned SUP items and seizure of material in addition to launching of Prosecution under Environment (Protection) Act, 1986 for Second Offence

C. Sale and Use of banned SUP items by Shops/Establishments/Institutes and Entities

i. Fine of Rs. 20,000 and seizure of banned items for First Offence

ii. Fine of Rs. 40, 000, seizure of banned items and cancellation of trade and other licenses in addition to prosecution through competent authorities
