Department of Consumer Affairs notifies enforcement date for provisions relating to Legal Metrology Act, 2009 under the Jan Vishwas (Amendment of Provisions) Act, 2026

Non standard measure leads to penalty

The Central Government through the Department of Consumer Affairs has notified 1st May 2026 as the date on which the provisions of the Jan Vishwas (Amendment of Provisions) Act, 2026, relating to the Legal Metrology Act, 2009 (“Act”), will come into force.

Key Changes under the Act:

  1. Under Section 25 of the Act, the penalty for use of non-standard weights or measures will include issuance of a warning with an improvement notice for the first offence, liability to a penalty which may extend to one lakh rupees for the second offence, and a fine not less than two lakh rupees but which may extend to five lakh rupees for subsequent offences.
  2. Under Section 26 of the Act, the penalty for alteration of weights or measures will be a fine which may extend to one lakh rupees for the second offence, and for the third and subsequent offences a fine of one lakh rupees will be imposed.
  3. Under Section 29 of the Act, the penalty for quoting or publishing non-standard units will be, for the first offence, involve a warning with an improvement notice, for the second offence attract a penalty which may extend to fifty thousand rupees, and for subsequent offences entail a fine not less than one lakh rupees but which may extend up to two lakh rupees.
  4. Under Section 31 of the Act, the penalty for non-production of documents will be, for the first offence, involve a warning with an improvement notice, for the second offence attract a penalty which may extend to twenty-five thousand rupees, and for subsequent offences be a fine of not less than fifty thousand rupees but which may extend up to one lakh rupees.
  5. Under section 37, in sub-section (1), for the words “shall be punished with fine which may extend to one lakh rupees”, the words “shall be liable to penalty which may extend to one lakh rupees” will be substituted.
