Govt. of Goa notifies the Factories (Goa Amendment) Act, 2019 to further amend the Factories Act, 1948 as applicable to the State of Goa

The Government of Goa, with a view to boost the manufacturing sector and to facilitate ease of doing business has recently notified the Factories (Goa Amendment) Act, 2019 (“Amendment”) and made the following amendments to the Factories Act, 1948 (“Act”) as in force in the State of Goa.
Key Highlights:
i. The Chief Inspector has been empowered to exempt any or all of the adult male workers in any factory or group or class or descriptions of factories from specific provisions of the Act, subject to specific terms and conditions to deal with an exceptional press of work;
ii. The total number of working hours per week has been increased from 60 to 72 and the total hours of overtime in any quarter has been increased from 75 to 125 hours;
iii. The State Government has been empowered to specify the conditions for ensuring the safety of women working in any factory or manufacturing process in night shifts (between the hours of 7:00 P.M. and 6:00 A.M);
iv. Further, section 92A and the Fourth Schedule have been inserted to enable compounding of certain offences before or after the institution of prosecution.
