With a view to create an effective Single Window System or delivery of services related to issuing of permissions required for establishing and operating industries and to facilitate Ease of Doing Business, the Government of Maharashtra has issued the Maharashtra Industry, Trade and Investment Facilitation Ordinance, 2023 (“Ordinance”) which has gained force with immediate effect.
Key Highlights:
- The Ordinance defines “Single Window System” as a State-level web-enabled online portal or platform meant for submission and processing of applications for permissions required by an industrial undertaking and an industrial undertaking as an undertaking engaged in manufacturing or processing or both or providing service or doing any other business or commercial activity as may be specified by the State Government;
- The Ordinance includes a provision which requires any person or a company having majority investment or controlling interest in an industrial undertaking to make an application through the Single Window portal for obtaining permission under the relevant laws;
- Further, the Ordinance has provisions regarding the Constitution, Powers and Functions of an Empowered Committee who would be in-charge of disposing all the applications for permission, appointment of Officers, formulate the guidelines and Standard Operating Procedure required for the effective implementation of the Single Window System and the provisions of the Ordinance.
