Kerala State Pollution Control Board (“KSPCB”) has issued a circular reiterating the requirement of obtaining consent to operate under the Air (Prevention and Control of Pollution) Act, 1981 and the Water (Prevention and Control of Pollution) Act, 1974. Commercial buildings established before 30.06.2015 (but not yet obtained ‘Consent to operate’) have been directed to obtain ‘consent to operate’ on or before 30th September 2024 by applying on the online portal of KSPCB with necessary consent fee and all other documents.
This is pursuant to the decision no 5.4 of the 24th Board meeting held on 19.02.2024, where it was decided that those high rise and other buildings (as defined in SOP for High rise & Other Buildings dated 15.03.2023) which had obtained occupancy certificate from the local self-government institution on or before 30.06.2015 and have not yet obtained ‘Consent to operate’, shall be allowed to apply for the first Consent to operate by remitting 5.5 times annual fee based on capital investment. After scrutiny and inspection, If found eligible, the consent will be granted for a period of five years up to 31.03.2029. It has been further clarified that as it is the first consent to operate, the applications will not be eligible for the fee concession applicable for renewal however the fee concessions may be availed during the subsequent renewals.
