The Maharashtra Pollution Control Board (“MPCB”) has notified regarding simplified scheme of auto-renewal of Consents based on Self-declaration submitted by the industry for Red, Orange, Green and Blue Category industries. The scheme is effective immediately.
Background:
The MPCB had introduced Auto Renewal of Consent based on Self-certification, initially for consents granted by CC/CAC committees of MPCB. With a view to simplify auto Renewal scheme, the MPCB has made applicable the scheme of Auto Renewal for Auto Renewal of Consent to Establish for industries which does not attract the provisions of EIA Notification 2006 and amendments thereto.
Key Highlights under the scheme:
- The scheme is applicable to all categories of industries i.e., Red, Orange, Green and Blue.
- The scheme also applies to Auto Renewal/Revalidation of Consent to Establish for industries which does not attract the provisions of EIA Notification 2006 and amendments.
- The simplified scheme of auto renewal will apply when there is no increase in overall production capacity and in pollution load.
- The auto Renewal scheme can be availed for 5 years to Red category industries, 10 years for Orange category industries; and 15 years for Green category industries.
- Industry will have to submit a Self-declaration in the prescribed format. Industry will have to submit this format along with the prescribed fees.
- The renewal will be reflected on the website within 07days.
- The applications for Auto Renewal of consent will be directly routed to respective granting authority as per delegation of powers.
- The respective granting authority will issue Auto Renewal of consent within 7 days period without carrying out visits to the respective industry and also submission before respective committees of the Board. The accorded Auto Renewal of consent shall be, placed for appraisal to appraised by the respective committees of the Board as per delegation of powers.
