Maximum amount of penalty levied on food business operators owing to delay in filing Annual Return capped at five times the annual fees under the FSS (Licensing and Registration of Food Businesses) Regulations, 2011

With a view to reduce the burden on Food Business Operators (“FBOs”), Food Safety and Standards Authority of India (“FSSAI”) has issued an Order to revise the maximum amount of penalties that may be levied on FBOs due to delay in submission of Annual Return under the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011.

Now, any delay in filing Annual Return beyond 31st May of each year will attract a penalty of Rs 100/- per day for delay till the date of filing the return. However, the maximum penalty shall not exceed five times of the annual fees.

This has gained effect from FY 2021-2022 for which the extended last date of return was 30th June 2022. Further the amount of penalty levied due to delay in submission of Annual Return w.e.f FY 2021-2022 (subject to maximum penalty levied not exceeding five times the annual license fee) is required to be paid by the food businesses before applying for renewal of license.
