Ministry of Labour and Employment issues instructions for regulating joint request under the Employees Provident Fund Scheme, 1952

In continuation to what we had reported earlier (please refer to mail below), the Ministry of Labour and Employment (“MoLE”) has issued the following instructions for regulating joint requests under Paragraph 26(6)* of Employees Provident Fund Scheme, 1952 (“Scheme”) :
- Any employee who intends to become a member of the Scheme and contribute to it on actual ( higher) pay exceeding the statutory limit ( presently Rs 15,000/- per month) shall submit a joint request with his employer in the attached proforma.
- The joint request will be made through the employer to the Regional Office.
- The employer to further undertake in the attached proforma application to pay the administrative charges as payable on actual ( higher) pay and to comply with all statutory provisions in respect of such employee.
- The employer should submit the joint request and the undertaking in the pro forma application duly signed by the employee and the employer to the jurisdictional Regional Office digitally.
These above instructions are applicable to the following employees :
- who will be enrolled in the Scheme
- existing members of the scheme who may intend to contribute on actual ( higher) pay in future when their wages exceed the then existing statutory ceiling.
All existing members who are already contributing on actual higher pay if they have not submitted their joint requests and undertaking of the employer, can submit the same at the time of final claim settlement.

* Para 26(6) Notwithstanding anything contained in this paragraph [an officer not below the rank of an Assistant Provident Fund Commissioner] may, on the joint request in writing, of any employee of a factory or other establishment to which this Scheme applies and his employer, enroll such employee as a member or allow him to contribute more than rupees [fifteen thousand rupees] of his pay per month if he is already a member of the Fund and thereupon such employee shall be entitled to the benefits and shall be subject to the conditions of the Fund, provided that the employer gives an undertaking in writing that he shall pay the administrative charges payable and shall comply with all statutory provisions in respect of such employee.
