Public comments invited on proposed requirement to declare composition of two or more prime constituents of commodity with the Brand Name/ Logo on front side of package: applicable to commodities containing more than one constituent

Public comments are invited by the Legal Metrology Division in the matter of declaring two or more prime constituents of the commodity on the front side of the package along with the brand name/ logo of the company under the Legal Metrology (Packaged Commodities) Rules, 2011 up to 31st August, 2022. Comments may be sent to js-ca@nic.in, dirwm-ca@nic.in and ashutosh.agarwal13@nic.in or physically be sent to the Director, Legal Metrology, Room No 461-A, Krishi Bhawan, New Delhi-01.

The proposed amendment prescribes that in the event a commodity contains more than one constituent, the front side of the package is required to have a declaration of two or more prime constituents of the commodity with the Brand Name and Logo on the front side of the package. Additionally, the declaration must contain the percentage/ quantity of unique selling point / unique selling proposition (USP) of the product and in the same font size in which the declaration of unique selling point / unique selling proposition (USP) is made.

However, the above-mentioned is not applicable to commodities that are mechanical or electrical in nature.

The amendment is proposed with a view to safeguard the interest of consumers as it has been observed that many manufacturers, packers and importers are not making important declarations prominently on the Front side of the Package which is a violation of consumer’s right of being informed.
