Uttar Pradesh Government proposes Draft Uttar Pradesh Occupational Safety, Health and Working Conditions Rules, 2026

The Uttar Pradesh Government has proposed the Draft Uttar Pradesh Occupational Safety, Health and Working Conditions Rules, 2026 (“Draft Rules”) under the Occupational Safety, Health and Working Conditions Code, 2019 (“Code”). Objections and suggestions to the Draft Rules may be addressed to the Principal Secretary, Shram Anubhag-3, Uttar Pradesh Shashan, Bapu Bhawan, Lucknow-226001 and Labour Commissioner, (Shram Sudhar Prakostha) Office at G.T. Road, Kanpur, within a period of 45 days from the date of its publication in the Official Gazette.

Key Proposals under the Draft Rules:

  1. Obtain registration by making an online application on the official web portal for registration of establishments by giving details about the establishment and uploading documents related to registration of the establishment, proof of identity and address.
  2. Fees pertaining to registration of establishments have been prescribed.
  3. Duties of employer in respect of health and safety of employees, annual health examination of employees, letter of appointment, notice of accidents and dangerous occurrences, notice of disease etc. have been laid down.
  4. Establishment of Safety Committee for the following class of establishments have been prescribed:
    • Establishments employing 250 or more employees;
    • Establishments in which dangerous operations are being carried out;
    • Major accident hazard factories
  5. Appointment of safety officers for the following class of establishments has been prescribed:
    • Factory having 500 or more workers; or
    • Factory carrying on hazardous process and employing 250 or more workers; or
    • Establishments carrying out building and other construction work and employing 250 or more workers; or
    • Major Accident Hazard installation; or
    • Factory carrying out manufacturing of sulfuric acid
  6. The daily and weekly working hours, weekly day of rest, wages for overtime and compensatory holidays have been laid down under the Draft Rules.
  7. Employers of establishments must maintain register of workers and employees, register of accidents and dangerous occurrences, register of wages, overtime register, register of leave with wages, electronically.
  8. Issuance of wage slips, and providing leave books to employees have been prescribed.
  9. Prescribes display of notice showing the name and address of the factory or establishment, hours of work, wage period, date of payment of such wages, details of accident and dangerous occurrence in the establishment for the last five years, etc, at the conspicuous places of the establishment.
  10. Employer of an establishment must send the following returns relating to the establishment to the Inspector-cum Facilitato:
    • Annual Return on or before January 31 of each year.
    • Half yearly return on or before July 31 of each year in case of a Major Accident Hazard installation for the period of January 1 to June 30.
  11. Prescribes conditions relating to employment of women in an establishment during night or before 6.00 a.m. and beyond 7.00 p.m.
  12. Conditions for grant of license to a contractor, procedure for issue of license, along with renewal of license have been specified.
  13. Prescribes provision of journey allowance for Inter-State Migrant Workers.
  14. Conditions for grant of license pertaining to beedi and cigar workers, procedure for issue of license, prescribed fees, renewal of license and welfare facilities have been specified.
  15. Procedure for obtaining approval of site plan for factories, registration certificate, establishment of occupational health centres for factories carrying on hazardous process have been prescribed.
  16. The Draft Rules have further specified the list of dangerous operations carried out in factories.
  17. Facilities for workers employed in plantation, which are required to be provided by employers have also been prescribed.
