CPCB issues Guidelines for Assessment of Environment Compensation to be levied for violation of the provisions under the Plastic Waste Management Rules, 2016

In sync with the provisions under the Plastic Waste Management Rules, 2016 (“Rules”) and its amendments, which mention levying of Environmental Compensation (“EC”), the Central Pollution Control Board has issued “Guidelines for Assessment of Environment Compensation to be levied for violation of the provisions under the Plastic Waste Management Rules, 2016”

Key Highlights:

  1. The guidelines have explicitly reiterated the provisions of the Rules and listed down the obligations on the producers, importers, Brand-Owners and the concepts of “Extended Producer Responsibility”, “Polluter pays principle”, etc.;
  2. The guidelines have divided the cost of assessment of plastic waste management that are taken into consideration while assessment of Environmental Compensation into the following:
  1. The cost incurred during transportation and collection of Plastic Waste;
  2. The cost of setting up of material recovery facility of plastic;
  3. The cost of setting up of Refused Derived Fuel per ton of plastic waste and;
  4. The operational and transportation cost per ton of plastic waste.
  1. The violations under the provisions of the Rules that would lead to the levying of EC have also been represented in the guidelines in a tabular form along with the amount of EC that would be levied and the concerned person on whom the obligation of payment of EC would be;
  2. Further, the minimum and maximum amount of EC that can be levied for violation of a particular provision has also been explained in detail;
  3. The guidelines have also mentioned that the Environmental Compensation Charges and Financial Penalty shall be deposited by the violating facility within the stipulated time period specified under directions issued by Central Pollution Control Board/State Pollution Control Board/Pollution Control Committee, as the case may be. The financial penalty in case of non-payment of Environmental Compensation on time has also been listed out.
