Environment Ministry amends Schedule III of Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016 to amend list of other wastes which can be imported/exported without prior consent

The Ministry of Environment, Forest and Climate Change has issued the Hazardous and Other Wastes (Management and Transboundary Movement) Second Amendment Rules, 2022 (“2022 Amendment”) to amend schedule III of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 (‘Principal Rules”).
The present amendment inserts the following as a category of waste in Schedule III (which deals with “List of other wastes applicable for import and export and not requiring Prior Informed Consent”)
“High End and High Value Used Medical Equipment other than Used Critical Care Medical Equipment for re-use (note the related entry in Schedule VI,B1110”
to time]
The 2022 Amendment further states that import is permitted in the country by actual user or by Original Equipment Manufacturers (OEM) or Indian Subsidiary of OEM or Trader on behalf of actual user.
