FSSAI directs food commissioners of all States and Union Territories to carry out special enforcement drives to check the quality and safety of Nutraceuticals / Health supplements manufactured and sold in the market

The Food Safety and Standards Authority of India (“FSSAI”) has directed food commissioners of all States and Union Territories and Central Licensing Authorities of FSSAI to ensure tight vigil on the manufacturing and sale of Nutraceuticals / Health supplement products and carry out special enforcement drives to check the quality and safety of the Nutraceuticals / Health supplements products sold in the market.

The Authorities are directed to check that the Food Business Operators (“FBOs”) are in compliance with the FSS (Health Supplements, Nutraceuticals, Food for Special Dietary Use, Food for Special Medical Purpose, and Prebiotic & Probiotic Food) Regulations, 2022. Strict Action will be taken against FBOs in case of any violation.

The action report for the above-mentioned is required to be submitted by 31st March, 2023.

Background:

FSSAI received a number of complaints about a large number of Nutraceuticals and Health Supplements being sold in the market which are not compliant with the provisions of the Food Safety and Standards (Health Supplements, Nutraceuticals, Food for Special Dietary Use, Food for Special Medical Purpose and Prebiotic and Probiotic Food) Regulation, 2022 apart from being marketed with false/ misleading and exaggerated health/ label claims in contravention with the provisions of the FSS (Advertisement & Claims) Regulations, 2018.
