The Environmental Impact Assessment (“EIA”) Notification, 2006 gets amended to include provisions regarding splitting of EC

The Ministry of Environment, Forest and Climate Change has recently issued amendments to the Environmental Impact Assessment (“EIA”) Notification, 2006 and inserted a new clause which provides that a prior Environmental Clearance (“EC”) granted for a specific project, not being a mining project, can be split amongst two or more legal persons who are entitled to undertake a project. The transferor can then transfer the EC during its validity to another legal person by making an application in the specified format on the PARIVESH portal to the concerned Regulatory Authority.

Background: Though the EIA Notification, 2006 has provisions for transferring prior EC from one legal person to another legal person during the validity period, there was no explicit provision for splitting an Environmental Clearance and transferring it to more than one legal person.
