Environment Ministry notifies the Hazardous and Other Wastes (Management and Transboundary Movement) Second Amendment Rules, 2024; effective 01-04-2026

The Ministry of Environment, Forest and Climate Change (“Ministry’) has notified the Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2025 (“Amendment”). The provisions of the Amendment will come into effect from 1st April, 2026.

Key Highlights: 

  • A separate chapter (Chapter VIII) on Extended Producer Responsibility (“EPR”) for Scrap of Non-Ferrous metals has been introduced and non-ferrous metals for the purpose of this chapter has been defined as ‘aluminium or copper or zinc or their alloys’;
  • Responsibilities of the different stakeholders mentioned under the Rules such as Manufacturers, Producers, Recyclers, Refurbishers and Bulk Consumers with respect to registration, filing of periodical returns, etc. have been specified;
  • EPR targets and responsibilities have been prescribed for Producers for recycling of scrap of non-ferrous metals;
  • Provisions with respect to levy of Environmental Compensation have been added in the chapter;
  • Schedules listing out products made of non-ferrous metals (Schedule X) and products made of non-ferrous metals allowed for refurbishing (Schedule XII) have been added.
