Bruhat Bengaluru Mahanagara Palike notifies the Bruhat Bengaluru Mahanagara Palike (Advertisement) Bye-Laws, 2024

The Bruhat Bengaluru Mahanagara Palike (“BBMP”) has notified the Bruhat Bengaluru Mahanagara Palike (Advertisement) Bye-Laws, 2024 (“Bye-laws”), under the Greater Bengaluru Governance Act, 2024 (“Act”). The Bye-laws shall be applicable to the Greater Bengaluru Area. The key compliances under the Bye-laws are mentioned below.

Key Highlights:

  1. The licensed advertising agency shall exhibit all advertisements other than self-advertisements*, on any road less than 18 meters in width, by adhering to the prescribed maximum size, dimensions, and permissible paid advertisement. *Self-advertisement means an advertisement or display visible to the public which is for informing about the activities carried out in such building/place/land.
  2. The owner of the premises and the advertiser shall remove all unauthorized or illegal advertisements.
  3. The licensed or registered advertiser shall display advertisements on behalf of other persons/agencies or participate in public auction/tender for advertising rights on the notified roads or circles. He shall also maintain a record of such advertisements.
  4. The advertising agency shall apply for grant of license to the Chief Commissioner in Form-I with required enclosures, along with challan for payment of registration or license fee of rupees five lakhs for a term of five years.
  5. The licensed/registered advertiser who has been assigned paid advertisement rights, shall inform about the erection or display of any paid advertisement (application in Form-III and renewal in Form-VI), to Special Commissioner in charge of the Advertisements.
  6. The advertiser shall display advertisements only after obtaining the written permission of the Chief Commissioner or his authorized officer, by applying in Form-V for Mobile Displays to the Advertisement department of BBMP.
  7. The advertiser shall not erect/exhibit/fix/retain display of advertisement without the permission of the Chief Commissioner.
  8. The advertiser shall ensure that text elements on an advertising hoarding is easily discernible to travelling motorists to minimize driver distraction and display a sign that easily conveys the message to the viewer and reduces the period of distraction.
  9. The advertiser shall not erect/exhibit/fix/retain display any advertisement or hoarding or billboard in any manner that has been explicitly prohibited under the Bye-laws.
