Andhra Pradesh Government proposes the Draft Occupational Safety, Health and Working Conditions (Andhra Pradesh) Rules, 2026; objections and suggestions may be addressed within 21st May 2026

The Andhra Pradesh Government has proposed the Draft Occupational Safety, Health and Working Conditions (Andhra Pradesh) Rules, 2026 (“Draft Rules”) under the Occupational Safety, Health and Working Conditions Code, 2019 (“Code”). Objections and suggestions to the Draft Rules may be addressed to the Commissioner of Labour, Andhra Pradesh, Vijayawada through the dedicated web portal of the Labour Department Web Portal https://labour.ap.gov.in/ and also through the e-mail address: aplabourcodes2026@gmail.com, or may be submitted in the office of Commissioner of Labour, Andhra Pradesh, papaiah street, seetarampuram,VIJAYAWADA-520010, within a period of 45 days from the date of its publication in the Official Gazette, i.e. 21st May 2026.
Key Proposals under the Draft Rules:
- Obtain registration by making an application to the Registering Officer by giving details about the establishment and uploading documents related to registration of the establishment, proof of identity and address.
- Fees pertaining to registration of establishments have been prescribed.
- Duties of employer in respect of health and safety of employees, annual health examination of employees, letter of appointment, notice of accidents and dangerous occurrences, notice of disease etc. have been laid down.
- Establishment of Safety Committee for the following class of establishments have been prescribed:
- Factories employing 250 or more employees;
- Factories categorized as Major accident hazard Installation;
- Factories engaged in hazardous process and employing 50 or more persons;
- Factories engaged in dangerous operations and employing 50 or more persons;
- Establishments engaged in building or other construction work and employing 250 or more persons;
- Appointment of safety officers and the number of safety officers to be appointed have been prescribed.
- The daily and weekly working hours, weekly day of rest, wages for overtime and compensatory holidays have been laid down under the Draft Rules.
- Employers of establishments must maintain maintain a register of workers, wages, overtime, and fine, deduction for damage or loss.
- The Draft Rules have further prescribed maintenance of record of leave, register of employees, register of accidents, and register of adolescent workers.
- Prescribes display of notice showing the name and address of the factory or establishment, hours of work, wage period, date of payment of such wages, details of accident and dangerous occurrence in the establishment for the last five years, etc, at the conspicuous places of the establishment.
- Employer of an establishment must send the following returns relating to the establishment to the Inspector-cum Facilitator:
- Annual Return within 1st February.
- Half yearly return.
- Prescribes conditions relating to employment of women in an establishment during night or before 6.00 a.m. and beyond 7.00 p.m.
- Conditions for grant of license to a contractor, procedure for issue of license, along with renewal of license have been specified.
- Prescribes provision of journey allowance for Inter-State Migrant Workers.
- Conditions for grant of license pertaining to beedi and cigar workers, procedure for issue of license, prescribed fees, renewal of license and welfare facilities have been specified.
- Procedure for obtaining approval of site plan for factories, registration certificate, establishment of occupational health centres for factories carrying on hazardous process have been prescribed.
- The Draft Rules have further specified the list of dangerous operations carried out in factories.
- Facilities for workers employed in plantation, which are required to be provided by employers have also been prescribed.
