All you need to know about the Haryana State Employment of Local Candidates Act, 2020 and Rules

Further to our post ‘the key obligations cast upon employers in light of the Haryana State Employment of Local Candidates Act, 2020’ given below, here’s to apprise you of the recent Order issued by the Haryana Labour Department granting deemed exemption to some categories of employers under the Act:

	New Startups and New IT / ITeS companies for 2 years. New Startups /IT/ITES means employer who has established or has commenced its operation within a period of 2 years, after the commencement of this Act i.e. 15.01.22
	Short Term Employment/s where the total duration is less than 45 days.
	Agricultural activities, such as growing/harvesting field crops, fruits, nuts, seeds, vegetables, tea, coffee, or raising animals, fish, or other animals from a farm, ranch, or their natural habitats. This exemption is not applicable to agricultural allied activities which involve manufacturing, trading, processing of agriculture products or produce, etc.
	Domestic work or services in residential homes.
	Vacancies, which are being filled up through promotion or transfer, or by absorption of surplus staff of any unit of the same employer in the State.
	Any class, post, skill and category of employment, as may be notified by the Government from time to time, where the Local Candidates of the desired skill, qualification or proficiency required in such employment are not available
