Comments sought on draft amendment to Tamil Nadu Shops and Establishments Rules proposing to include provisions on registration of establishments, availability of first-aid facilities

Tamil Nadu Labour Welfare and Skill Development Department has issued draft amendment to the Tamil Nadu Shops and Establishments Rules, 1948 seeking objection or suggestion till 8th December, 2023. Objection or suggestion, if any, should be addressed in duplicate to the Additional Chief Secretary to Government, Labour Welfare and Skill Development Department, Secretariat, Chennai-600 009 through the Commissioner of Labour, Chennai-600 006.

The following new rules are proposed to be made:

  1. Process of registration of establishment – Every application for registration of an establishment must be made online in Form-Y with a fee of Rs.100/ through the designated web portal of the Labour Department. The registration certificate will be issued online in Form – Z.
  2. Existing establishments in existence on the date of commencement of the Tamil Nadu Shops and Establishments (Amendment) Act, 2018 must furnish details of their establishment in Form ZB to the Inspector of the area in which the establishment is located.
  3. Amendment of registration certificate – The application for amendment of a registration certificate must be made online, through the designated web portal of the Labour Department. A fresh registration certificate will be issued online in Form – Z.
  4. First-aid Facilities – Every establishment must have one first-aid box for every one hundred and fifty persons and must be maintained so it is readily accessible during all working hours. The first-aid box must be distinctively marked with a red cross on a white background and contain basic first aid related materials for treating small injuries. Immediate recoupment of the equipment must be arranged for.

Additionally, the penalty under the Rule for any contravention is proposed to be increased form Rs.50/- to Rs.2,000/-
