Delhi Labour Department publishes draft notification exempting warehouses in NCT, Delhi from certain provisions of the Delhi Shops and Establishments Act, 1954
the Government of Delhi has issued a draft notification to exempt warehouses in NCT of Delhi by amending Schedule-I which specifies “Exemptions” under the Delhi Shops and Establishments Act, 1954.
In this draft notification, the warehouses in NCT of Delhi have been provided exemptions from the following sections :
- Section 14 which states that No Young persons and women shall work after daytime which is between 9 P.M. and 7 A.M.
- Section 15 which states No shop or commercial establishment should open before or close later than the prescribed government time.
- Section 16 which states that every shop and establishment shall remain closed on a ‘close day’.
However, the above exemptions have been granted subject to certain conditions regarding total working hours, shift working, safety and transportation, weekly off, compensatory leave, providing other legal benefits etc.
This exemption, however, will have no overriding effect on any notification/circular/order/advisory by the Government.
