With a view to amend the E-Waste (Management) Rules, 2022 (“Rules”), the Ministry of Environment, Forest and Climate has notified the E-Waste (Management) Amendment Rules, 2024 (“Amendment”). The Amendment has gained effect since 8th March, 2024.
Key Highlights:
i. With the Amendment gaining effect, a new provision has been incorporated which states that the period within which any return or report is to be filed under these Rules by a manufacture, producer, refurbisher or recycler can be relaxed by the Central Government for an additional period of 9 months;
ii. The definition of “dismantler” has been revised to mean ‘any person or entity engaged in dismantling of used electrical and electronic equipment and components thereof in accordance with the guidelines of the Central Pollution Control Board made in this regard’. Previously, the dismantler was required to be authorised by the concerned State Pollution Control Board (“SPCB”) or Pollution Control Committee (“PCC”);
iii. New provisions with regard to transaction of extended producer responsibility (“EPR”) certificates have been included by virtue of which, the Central Government has been given the power to establish 1 or more platform for exchange or transfer of extended producer responsibility certificates in accordance with the guidelines issued by the Central Pollution Control Board (“CPCB”);
iv. Further, it has been stated that the CPCB will be responsible for fixing the highest and lowest price for exchange of EPR certificates which will be equal to 100% and 30% respectively of environmental compensation which would be levied in case of non-fulfilment of the EPR obligation.
