Enhanced fines and reduced imprisonment for violations under Pharmacy Act 1948 effective 31st December, 2024: Health Ministry confirms implementation date for amendments under Jan Vishwas Act

The Ministry of Health and Family Welfare has appointed 31st December, 2024 as the date on which the amendments pertaining to the Pharmacy Act, 1948 (“Act”) will gain effect.

Key Highlights:

  1. For falsely claiming or implying that name is listed in the State’s official register will face a fine of up to Rs. 1 lakh for a first offence, with subsequent offences incurring fines of up to Rs. 2 Lakhs. Further, the imprisonment term for repeat offenses has been reduced to three months.
  2. If a person other than a registered pharmacist compounds, prepares, mixes, or dispenses any medicine on the prescription of a medical practitioner they will be subject to a fine up to Rs. 2 Lakhs or a reduced imprisonment of 3 months from the erstwhile 6 months or both.
  3. For wilfully obstructing an Inspector will now attract a financial penalty that may extend to one lakh rupees as opposed to the erstwhile penalty of imprisonment for up to six months or a fine not exceeding one thousand rupees.
