Environment Ministry issues Draft Regulation of Common Effluent Treatment Plants Rules, 2022

The Ministry of Environment, Forest and Climate Change has recently issued the Draft Regulation of Common Effluent Treatment Plants Rules, 2022 (“Draft Rules”) to introduce a three-tier monitoring mechanism while managing common effluent treatment plants (“CETP”) and has proposed the following:
1. The Draft Rules proposes to specify roles and responsibilities of the Pollution Control Authorities i.e., the State Governments, Pollution Control Boards and Pollution Control Committees with regard to monitoring of the CETPs, proper carriage of the effluents, levying of Environmental Compensation in case of violation, etc.
2. The Draft Rules also proposes, the introduction of Special Purpose Vehicle (SPV) or Society (registered under the Societies Registration Act, 1860) or Trust (registered under an appropriate statute), which would be responsible for the entire operation and maintenance of CETP. In addition to this, the Draft has also listed down the responsibilities of the CETP operating agencies.
3. Further, discharging and monitoring responsibilities of the trade effluents have also been levied upon the member industries of a CETP.
All these changes have been proposed to be incorporated in Schedule I, appended to the Environment (Protection) Rules, 1986.
