FSSAI directs FBOs to submit pre-approval self-certification before printing, airing and displaying digital advertisement

The Food Safety and Standards Authority of India (“FSSAI”) has issued an Advisory directing all food business operators (“FBOs”) to comply with Supreme Court’s directive with regards to advertisement approval. FBOs are required to submit a self-declaration before an advertisement is printed / aired / displayed, certifying that the advertisement does not violate advertising code which is underlined under Cable Television Networks Rules, 1994. Ministry of Information and Broadcasting introduced a new feature on Broadcast Seva Portal of MIB for TV & Radio and Press Council of India’s portal for print/digital/internet for uploading and generating of Self-Certificate by FBOs before telecast/publishing advertisement. This portal became operational since 4th June, 2024.

The FBOs are required to provide proof of uploading of self-declaration to the concerned broadcaster/printer/published/TV Channel/electronic media for records.
