Garments / hosiery products sold in loose or open form are exempted from compliances under Legal Metrology (Packaged Commodities) Rules subject to declaring manufacturer address, MRP, size, country of origin etc. effective from 1st January, 2

The Ministry of Consumer Affairs has notified further amendments to the Legal Metrology (Packaged Commodities) Rules, 2011. The amended Rules are called Legal Metrology (Packaged Commodities) (Third Amendment) Rules, 2022, which will gain effect from 1st January, 2023.

Garments or hosiery products which are sold loose or are open at the point of sale (in a manner that consumers may inspect the products before buying) are exempted from compliance obligations prescribed under the Legal Metrology (Packaged Commodities) Rules, subject to such products bearing the following details:

  • name and address of the manufacturer or marketer or brand owner or importer with country of origin or manufacture in case of imported products;
  • consumer care email id and phone number;
  • sizes with internationally recognizable size indicators such as S, M, L, XL, XXL and XXXL along with details in metric notation in terms of cm or m (as the case may be);
  • maximum retail price of the package inclusive of all taxes in Indian currency

 

Note: The exemption will only be applicable to the sale of finished products.

E-commerce websites selling the above-mentioned products are required to display the prescribed details on their websites.

While the change is slated to gain effect from 1st January, 2023, manufacturers, packers and importers may declare the above information with immediate effect.
