Government withdraws Personal Data Protection Bill 2019; new bill with recommendation of the Joint Parliamentary Committee to be presented

The Ministry of Electronics and Information Technology (“MEITY”) has withdrawn the Personal Data Protection Bill 2019 (“Bill”) and proposed to present a new Bill that will fit into the comprehensive legal framework basis the recommendations made by the Joint Parliamentary Committee.

Background:

​In December 2019, the Bill was first introduced in the Lok Sabha and thereafter it was referred to the Joint Parliamentary Committee on 11th December 2019. Subsequently, two years later, on 16th December 2021, the Joint Parliamentary Committee (JPC) looking into the 2019 Bill, had tabled a report in both houses of the Parliament providing its recommendations and changes therein. The Annexure to the report contained a draft ‘Data Protection Act 2021’ which incorporated changes suggested by the Committee (please refer to the e-mails in trail e-mails for details).

The Bill is withdrawn as the Ministry is working on a comprehensive legal framework basis the report of the Joint Parliamentary Committee.
