Govt. of Maharashtra notifies amendments to the Maharashtra Fire Prevention and Life Safety Measures Act, 2006

The Government of Maharashtra has notified the Maharashtra Fire Prevention and Life Safety Measures (Amendment) Act, 2023 (“Amendment”) to further amend the Maharashtra Fire Prevention and Life Safety Measures Act, 2006 (“Act”).
Key Highlights:
- The definition of the term “Building” has been revised and temporary structure such as tents, shamiyanas and the tarpaulin shelters erected for temporary and ceremonial occasions have been included within the purview of building;
- The owner or occupier of a building is required to obtain a Provisional Fire Safety Approval (at the time of building plan approval), a Final Fire Safety Approval (before granting building completion certificate or occupancy certificate) or Renewal of Fire Safety Approval (as the case may be), from the Chief Fire Officer of the concerned local authority or planning authority; and where there is no Chief Fire Officer in such area or in the area outside the limits of the local authority or planning authority from the Director;
- An owner or occupier of a building which is more than 30 metres high and used as a hotel, hospital, business, mercantile or mixed occupancy, is required to conduct a Fire and Life Safety Audit within a period of 1 year from the date of commencement of the Amendment i.e., 11th May, 2024 and thereafter, once in every two years;
- Further, Schedule I (Minimum Requirement for Fire Fighting Installation) and Schedule II (Fire and Emergency Service Fee Structure) appended to the Act have been revised.
