Industrial Relations Code (Amendment) Act, 2026 received assent of the President on 16th February 2026 clarifying the functioning of the Tribunals and statutory authorities under the repealed Acts

The Industrial Relations Code (Amendment) Act, 2026 (“Amendment Act”) has received assent of the President on 16th February 2026 andgained retrospective effect from 21st November 2025.
The Amendment Act substitutes sub-section (1) of Section 104 of the Industrial Relations Code, 2020 (“Code”). The revised provision clarifies the repeal of the three specified labour laws:
- The Trade Unions Act, 1926 (16 of 1926);
- The Industrial Employment (Standing Orders) Act, 1946 (20 of 1946); and
- The Industrial Disputes Act, 1947 (14 of 1947).
However, the Tribunals and statutory authorities constituted under the above-mentioned repealed Acts will continue to function until the corresponding bodies established under the Code becomes functional.
