The Government of Andhra Pradesh has on 25th March, 2025 temporarily exempted all Information Technology Enabled Services (‘ITeS’) and Information Technology Establishments in Andhra Pradesh from the provisions of Sections 15 (Opening and closing hours), Section 16 (Daily and Weekly hours of work), Section 21(Special provision for young persons), Section 23 (Special Provision for Women), Section 31(Other holidays) and sub-sections (1) (2) (3) and (4) of Section 47 (Conditions for terminating the services of an employee, payment of service compensation for termination, retirement registration, resignation, disablement etc., and payment of subsistence allowance for the period of suspension) of the Andhra Pradesh Shops and Establishments Act, 1988.
The exemption would be valid for a period of five years from the date of publication of the Notification in official gazette i.e., until 25th March, 2030.
Key Highlights:
The exemption shall be subject to the following conditions:
- Weekly working hours for employee shall be upto 48 hours per week, with overtime wages for extra hours;
- Employees are entitled to a weekly off and compensatory leave if working on notified holidays;
- Women employees can work night shifts with adequate security and company-provided transport;
- Employees shall receive ID cards and other benefits per applicable rules;
- Companies shall verify background of the drivers and maintain records of their details;
- The designated supervisors shall check the vehicles on different routes;
- Employee contact details, particularly of female employees, shall not be disclosed to unauthorized persons.
- The routes for cab drop-offs should be decided in a way that no female employee is picked up first and dropped last, unless accompanied by a security guard provided to them by the establishment before and after the defined hours.
- The boarding and aligning points should be covered by the CCTVs installed by the Police or by the establishment itself.
- Companies shall use GPS-based vehicle movement tracking, register vehicles under VAHAN, and ensure employees download security app of the police department.
- Employee returns shall be submitted online as directed by the Labour Facilitation Bureau (LFB) Department via the Ease of Doing Business (EODB) or Industries department websites.
Contravention of the above conditions may result in automatic revocation of the exemption granted to Information Technology Enabled Services (ITES) and Information Technology Establishments under this order without assigning any prior notice.
