Karnataka State Pollution Control Board (“KSPCB”) had issued a notice on 7th November* to all the producers of Electrical and Electronic Equipment (EEE) re-iterating that the E-Waste (Management) Rules, 2022 has repealed the E-Waste (Management) Rules, 2016 (“2016 Rules”), thus the producers are required to migrate to and comply with the E-Waste (Management) Rules, 2022 (“2022 Rules”). In pursuance to this, the producers are required to submit a detailed compliance report with respect to the transition from 2016 Rules to the provisions of 2022 Rules within 7 days from receipt of this notice to the Senior Environmental Officer, Waste Management Cell 1 (wmcl.kspcb@gmail.com), Parisara Bhavan, KSPCB. The producers are directed to include the following details in the report:
- Extended Producer Responsibility (“EPR”) Registration
- EPR Targets
- Details on recycling and disposal of E-Waste
- End-of-life Product Management
Producers failing to submit the compliance report within 7 days of the receipt of the notice will be liable for legal actions mentioned below under the 2022 Rules and Environment Protection Act, 1986:
- Revocation or cancellation of Consent issued under Water Act and Air Act
- Revocation or suspension of EPR authorization and registration with the Central Pollution Control Board (CPCB)
- Imposition of Environmental Compensation (EC) for non-compliance with EPR Targets
- Further legal actions, including penalties of fines and imprisonments for non-compliance with environmental regulations
